These Terms of Use (“Terms”) govern your use of the Waay app, website, and related route-planning services (together, the “Service”). By creating an account or using the Service, you agree to these Terms and the Privacy Policy.
1. The Service
Waay helps cyclists discover, plan, adapt, save, and share routes. The Service uses mapping, place, elevation, weather, and connected third-party data to make suggestions. Some requests may also use automated model processing. Features and availability may vary by location, device, account, and subscription tier.
2. Eligibility and accounts
You must be legally able to agree to these Terms. If you are under the age of legal majority where you live, a parent or guardian must review and agree to these Terms for you. You are responsible for accurate account information, safeguarding your credentials, and activity under your account. Tell us promptly if you believe your account has been compromised.
3. Cycling, navigation, and safety
Waay is a planning aid, not a guarantee of safety.Routes, surfaces, closures, traffic, access rules, weather, hazards, and conditions can change or be shown incorrectly. A suggested route may include roads or trails that are unsuitable, private, closed, or prohibited for cycling.
Use your own judgment, obey local laws and signs, check current conditions, carry appropriate equipment and supplies, and choose a ride suitable for your health, ability, bike, and environment. Do not interact with the Service while riding when doing so would be unsafe or unlawful. Waay does not provide emergency, medical, or professional training advice. In an emergency, contact local emergency services.
4. Route information and suggestions
Routes, explanations, timings, nutrition suggestions, and briefings may be incomplete or wrong. Verify important information independently before relying on it. You remain responsible for your route choices and real-world decisions.
5. Subscriptions and purchases
Some features require a paid subscription. Prices, billing periods, trials, and included features are shown before purchase. Purchases made in the iOS app are billed by Apple to your App Store account and are subject to Apple’s payment terms. Unless stated otherwise, a subscription renews automatically until canceled at least 24 hours before the end of the current billing period. You can manage or cancel it in your Apple account’s subscription settings.
Payments are generally non-refundable except where Apple’s rules or applicable law provide otherwise. We may change subscription prices or features with the notice and consent required by the App Store or applicable law.
6. Your content and sharing
You keep ownership of content you submit to Waay. You give Waay a limited, worldwide, non-exclusive license to host, process, reproduce, and transmit that content only as needed to operate, secure, and improve the Service and provide features you request.
You are responsible for having the right to submit your content. If you create a journey-sharing link, anyone with that link may view the shared information. Only share routes you are comfortable disclosing, and revoke links you no longer need.
7. Acceptable use
You may not:
- use the Service unlawfully or to harm another person;
- submit content that infringes another person’s rights;
- probe, disrupt, overload, or bypass the Service’s security;
- use automated means to scrape or access the Service without permission;
- misrepresent your identity or access another person’s account; or
- reverse engineer or copy the Service except where applicable law expressly allows it.
We may limit or suspend access when reasonably necessary to protect users, Waay, or the Service.
8. Third-party services
Waay works with services such as Apple, Google, Stadia Maps, Strava, OpenAI, and RevenueCat. Their services may be governed by separate terms and privacy policies. Waay is not responsible for third-party services, data, routes, availability, or acts outside our control.
9. Waay’s rights
Waay and its licensors own the Service, including its software, branding, interface, and original content. These Terms do not transfer those rights to you. We give you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service under these Terms.
If you send feedback, you allow us to use it without restriction or compensation, provided we do not publicly identify you without permission.
10. Changes and availability
We may add, change, suspend, or discontinue features. We will provide notice when required by law. We do not promise that the Service will always be uninterrupted, error-free, or available in every location.
11. Termination
You may stop using Waay at any time. You may request account deletion using the developer contact on Waay’s App Store product page. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or use the Service abusively. Terms that by their nature should survive termination will remain in effect.
12. Disclaimers and liability
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.
To the fullest extent permitted by law, Waay will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from the Service. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.
13. Applicable law and disputes
These Terms are governed by the laws that apply to Waay’s provision of the Service, without overriding mandatory rights you have under the laws of your country of residence. Before starting formal proceedings, please contact us and give us a reasonable opportunity to resolve the issue informally.
14. Changes to these Terms
We may update these Terms as the Service changes. We will post the new version here and update the date above. If a material change requires notice or consent, we will provide it. Continuing to use the Service after updated Terms take effect means you accept them where permitted by law.
